Businesses that emit pollutants into the air need permits from the New York State Department of Environmental Conservation (DEC). Facilities that emit at low levels must register as an Air Facility.



Businesses that emit pollutants into the air need permits from the New York State Department of Environmental Conservation. Facilities that emit at low levels must register as an Air Facility.

Pollutant Air Facility Registration State Facility Permit
  • nitrogen oxides (NOx) or
  • volatile organic compounds (VOC)
emits less than 12.5 tons per year (tpy) of either emits more than 12.5 tpy of either
  • sulfur dioxide (SO2)
  • carbon monoxide (CO) or
  • particulate matter (PM)
emits less than 50 tpy of any emits more than 50 tpy of any
  • any hazardous air pollutant (HAP)
emits less than 5 tpy of any one HAP and less than 12.5 tpy total of any combination of HAPs emits more than 5 tpy of any HAP or more than 12.5 tpy in combination of HAPs
  • persistent, bioaccumulative or toxic compounds (6 NYCRR Subpart 201-9, Table 1)
no more than allowed for by Table 1 more than allowed for by Table 1

Businesses with facilities that exceed these criteria need a Title V Permit, which regulates "major sources," such as industrial plants and mills.
